So What Are Performing RIghts Societies?
So What Actually Are Performing Right Societies?
Performing
Rights Societies go back a long way but essentially are part of a
system of collecting earnings for their registered customers (artists)
from businesses and professional individuals that use their music in
some way. But what does this mean for businesses who want to use music,
and the artists who want to work with these businesses?
|

|
If you buy a CD
from a record store, or purchase a download from (say) iTunes you will
be purchasing the music you are also gaining the right to use the music
for non commercial uses such as listening to the music at home and with
friends and family. You will not have the right to use the music for
any public use such as an exhibition or commercial event, for a backing
to a DVD that you sell, or any other business or charity use.
If you are a business or a business professional that wants to use
music that is registered to a performing rights society in some way,
you will need to buy a license from them that matches your use.
Most commonly music is registered with a
performing rights society for collection of all royalties due for the
music with various different uses such as use on the radio and on the
TV as well as use as background music in a store for example.
Artists register their music because they believe their music will earn
money from a
lot of use from, for example, radio play. But the reality is very
different for many. Clearly, a chart topping act will gain a lot of
income from
a track that many radio stations want to play. If it is in the charts,
people want to hear it and (in theory) radio stations want to play
it... or is it the other way around!!.
But I digress.

Performing rights societies
are there to protect and collect these
artist's earnings from everywhere they can find their music being used.
Sometimes it is easier than others to uncover use. For example,
broadcasters are required to list the music they have used in their
broadcast. These lists are called 'cue sheets' and detail to the
performing rights society which artists should get paid for the use of
their music. The performing rights society then shares out the license
fee from that broadcaster across those artists who have had their music
listed.
Other uses are not so east to track. For example, look at the hundreds
of thousands of stores, supermarkets, waiting rooms, restaurants,
hotels, motels, dental clinics, doctors, vets, cafes, bars, clubs,
cinemas, theatres... the list goes on... that will play some form of
music as background music during a given day. How can you possibly
identify exactly who's music has been played, and even spending money
on people to spot check can only go so far in terms of identifying what
is being played.
Artists who are not as well known will not get a piece of this pie
because of the way the performing rights assumes that music played as
background music in businesses will tend to parallel the most popular
music artists of the day, which, although is a reasonable stab at making
sense of sharing that income, actually doesn't come close to recognising
the artists actualy being used.
Royalty Free Here At Background Music Library Means
Performing Rights License Free

We license our music for background use in public areas with no
additional
royalties to pay. So that means no additional performing royalties are
due directly to us or via a performing rights society. Performing
royalties are normally collected for being used in businesses by the
performing rights societies but they have no rights to collect
royalties with our music as our artists choose us instead of the
performing rights societies to license their music. Some of our artists
do both, some music for film and TV via the performing rights society
and some to us for use as background music, royalty free.
So, to be clear, if you use our music, without any other music that is
not royalty free in the same way as our music, you will not have to pay
any additional fees to us or to a performing rights society. So you can
cut your costs by not having a performing rights license to pay. Our
music comes with a printable license that details the rights you have
purchased that can then be stuck on your store's wall to show you have
the right to use our music truly royalty free.
So not only can you costs be reduced at the same time you gain from the
supply of sourced and vetted great music in various collections and
styles. We master our music so it is all balanced against a common
volume standard. We also convert each track to mono so that you have
the same mix of music coming from all the speakers you have in your
business environment.

I hope
this is clear, I appreciate the concept is not easy to follow.
Background
Music Library can provide the supply
of music to be used in the background of your stores, in your hotel,
your restaurant, your spa or anywhere a business needs music for
background use.
We offer a permanent license purchase for each track
or
album, or a rental model that provides you with a collection of
music licensed for a month. Each month we replace part of the music
with new music to keep the collection fresh. This is what we do for
many clients today and it works well for breathing life into background
music for stores. Its the same for using our music as background music
in a DVD. |
If you have any questions about our music and the licensed uses please
use the Contact Us form and we will be happy to help.
